Have the BNP signed a contract with the EHRC? If I wanted to set up a political party and invite like minded folk to join and campaign to change things surely I can and have the right to do so without having to comply to someone else's set of ideals. They can't sue you if a contract hasn't been signed. Is the EHRC the law? What is written in the Magna Carta and the 1689 Bill of Rights?
